Dual Intent

A doctrine permitting some nonimmigrants to also have an intent to immigrate.

Dual intent allows certain nonimmigrant visa holders (notably H-1B and L-1) to pursue a green card without jeopardizing their nonimmigrant status. Most other nonimmigrant categories — including B, F, and TN — require nonimmigrant intent.
